The Peshawar High Court has refused to give immediate relief against the emergency and governor’s rule in Khyber Pakhtunkhwa.

A division bench heard the petitions on Tuesday. Justice Ijaz Anwar and Justice Muhammad Faheem Wali were on the bench.

The court issued notices to the federal government, the attorney general and the advocate general. They must reply within 10 days. The next hearing will be held on 10 November.

The judges rejected the request for quick interim relief. They also refused to order a stop to what the petitioners called revenge actions against the PTI.

A request for an earlier hearing date was turned down as well.

The petitions were filed by PTI chairman Barrister Gohar Ali Khan and leaders of the National Democratic Movement, including Mohsin Dawar.

Their lawyers argued that the provincial government had not lost control of the province. They said the emergency and governor’s rule were against the constitution and an attack on provincial autonomy.

In a separate case, the court heard pleas for the recovery of Chief Minister Sohail Afridi and Assembly Speaker Babar Saleem Swati. The court was told that more than 10 days have passed since the two went missing.

The bench issued notices to the KP inspector general of police and the CCPO Peshawar. That case will be heard again on 30 October.

Speaking to the media, Gohar claimed that 12 PTI MNAs and 14 MPAs have been picked up. He demanded their release.
